Under Order VIII Rule 6A CPC:

Counter claim can be permitted to be filed either before or after the filing of the suit but before the defendant has delivered his defence

Counter claim has to be mandatorily filed with the written statement.

Counter claim filed after filing of the written statement is barred

Counter claim cannot be filed with the written statement.
